A mediator is a trained professional who acts as a neutral facilitator during the mediation process. Mediators bridge the interests of two or more opposing parties by defining their challenges and eliminating communication obstacles. They guide the conversation and the process to minimize confrontation and other challenges. They help parties discuss disputes and reach a mutually agreeable solution which is then put into a signed agreement.
Mediation is often considered better than going to court for several reasons. It is generally less expensive and quicker than a court proceeding. The process is also private and not part of the public record. Mediation can promote good communication between parties and encourage good suggestions about the expected outcome. People are generally more satisfied with the outcome because they collectively reached an agreement.
When parties are unwilling or unable to resolve a dispute, one good option is to turn to mediation. Mediation is generally a short-term, structured, task-oriented, and "hands-on" process. In mediation, the disputing parties work with a neutral third party, the mediator, to resolve their disputes. The mediator facilitates the resolution of the parties' disputes by supervising the exchange of information and the bargaining process. The mediator helps the parties find common ground and deal with unrealistic expectations. He or she may also offer creative solutions and assist in drafting a final settlement. The role of the mediator is to interpret concerns, relay information between the parties, frame issues, and define the problems.
